For years when a new home buyer walked into a builder to purchase a new construction home, they were enticed with all sorts of goodies like a upgrades or paid closing cost etc. but there was a catch. You had to use their lender or no incentives. Many new home buyers who walked into these model homes without buyer representation could easily be taken advantage of by the builder's sales staff and get wrapped up in the emotion and excitement of the process without having all the facts.
Many new home buyers would cave in and use the builders preferred lender only to get hit up with a lot of lender junk fees and a higher interest rate. Ultimately the process made many new home buyers compare the process to going to a car lot to buy a car. The more they negotiated the price down or add-ons "given" to them by the builder, the higher the interest rate or loan origination fees which were tied to the offer. So in the end there was very little benefit if any. This was equally frustrating for many lenders who knew they were providing the better deal but lost the loan due to the enticements offered by the builder.
Well HUD (housing and urban development) is on the way to fix that. According to RESPA (real estate settlement and procedures act), builders have been manipulating new home buyers for way too long and they are going to regulate and enforce that a new home buyer can choose any lender they want and still be eligible for the builder's offered incentives. This will allow the consumer a choice in their lending options. Stay tuned for an update on when this regulation finally comes to pass.

If you are in the process of or thinking of buying a home in the near future, the rules have changed. FNMA (Fannie Mae) is going to institute a new rule prior to FUNDING the loan....meaning when all is signed and ready for the wire to be sent to the closing attorney.........they are going to pull a new credit report. IF the scores have moved down or any new debt is discovered, the loan will NOT close. It's still up in the air how many points it moves, but we have heard even 1 point lower will kill the deal.
So if you are under contract to buy a home, please DO NOT USE REVOLVING CREDIT or open any new credit until after closing. DO NOT USE YOUR CREDIT CARDS or be tempted to go to Rooms To Go or Lowes or wherever to purchase "things" for the new house! Once Fannie does this, Freddie, FHA and VA will follow! If you are thinking of buying a home go on your "debt diet" now. That means no credit usage, like even filling up with gas....start using cash and do not use credit cards during the process.
